What does the Aircraft Rental Agreement entail?

The Flex Air Aircraft Rental Agreement outlines renter responsibilities, including financial liabilities, operational requirements, insurance coverage, use restrictions, and maintenance protocols, ensuring safe and accountable aircraft usage.

The Aircraft Rental Agreement at Flex Air outlines the responsibilities and conditions for renting an aircraft for flight training. Here are the key elements of the agreement:

  1. Aircraft Ownership and Condition:

    • The aircraft is the property of the Operator (Flex Air).
    • Renters must inspect the aircraft before flight and confirm it is in good mechanical condition and airworthy.
    • Any mechanical malfunctions must be reported to the Operator immediately, without attempting to repair the aircraft themselves.
  2. Financial Liability:

    • Renters are personally liable for paying rental fees, service and time charges until the aircraft is returned, and any parking, tie-down, or hangar charges.
    • Renters are responsible for any loss or damage to the aircraft during the rental period.
  3. Aircraft Return:

    • The aircraft must be returned at the scheduled time, properly secured after each flight.
  4. Operational Requirements:

    • Renters must hold at least an FAA Private Pilot Certificate, a current flight review, a medical certificate, and meet currency requirements.
    • Only instrument-rated pilots with appropriate currency can rent for IFR flights.
    • A proficiency demonstration with an instructor is required before granting scheduling privileges.
    • Rentals are restricted to paved runways of no less than 2,000 feet.
  5. Insurance and Liability:

    • Renters are covered under Flex Air's insurance policy with specific liability limits.
    • Renters are encouraged to purchase additional "Aircraft Renters Insurance" to protect against negligence or damages.
    • Renters may be responsible for any portion of the $2,500 deductible for physical damage insurance as deemed appropriate by Chief staff.
  6. Use and Restrictions:

    • Flex Air aircraft cannot be used for illegal activities, races, speed tests, or contests, and must not be operated outside the continental United States or to carry passengers or property for compensation.
    • Pets and certain food and drinks are allowed with prior permission and responsibility for cleanliness.
    • Smoking is prohibited in the aircraft, and violators will incur cleaning fees.
  7. Maintenance and Emergencies:

    • Renters must notify Flex Air of any off-site maintenance issues immediately.
    • Flex Air will reimburse for fuel purchased off-site if a receipt is provided, but not for other expenses like hotel stays or rental cars due to mechanical delays.
    • In case of accidents or incidents, Renters must follow the Emergency Response Plan and report to the supervisor as soon as it is safe to do so.

This agreement ensures the safe and responsible use of Flex Air's aircraft, maintaining high standards of operation and accountability for all renters.
